The concern is not just commercial surveillance but coercion: employers mandating neural monitoring for productivity, governments requiring BCI interfaces for certain roles, or insurers using neural markers for risk assessment.
Therapeutic vs. Enhancement Use
The ethical case for BCIs is strongest in therapeutic contexts: restoring speech after ALS, treating treatment-resistant depression with DBS, restoring motor function after spinal injury. The ethical terrain becomes more contested as BCIs move toward cognitive enhancement — faster memory recall, attention augmentation, direct brain-to-brain communication.
Enhancement BCIs will not be available to all. Access will initially be gated by cost, then by geography, then by social norms. The risk is a bifurcated cognitive landscape where augmented individuals have meaningful advantages in economic, educational, and political contexts over unaugmented peers.
What Regulation Would Require
Effective governance of BCIs would require: explicit informed consent protocols specific to neural data, strict limits on secondary use of neural data, mandatory security standards for BCI devices, independent audit rights for neural data processing, and international coordination given the global nature of device manufacturers and data flows.
